On 2:21 a.m. on May 3, a Eugene Police officer was conducting a patrol check at Lincoln St / W. 8th Ave and spotted a Lexus sedan being driven without its headlights on and the driver was failing to sign a turn. The car turned into a parking lot at 300 W. 7th Avenue. As the passenger and driver were getting out, the officer activated his overhead lights to indicate the driver was subject to a traffic stop. The driver appeared intoxicated, so officers began an investigation. The passenger, a female, argued and got very close to all three officers on scene, but eventually angrily left the area.

After an investigation, the driver, Bennie DeAngelo Muniz, age 50, of Eugene, was issued criminal citations for DUII – Alcohol / Stimulant / Marijuana, Reckless Driving, Unlawful Possession Controlled Substance Schedule 1 – psilocybin (misdemeanor), Unlawful Possession Controlled Substance Cocaine (misdemeanor). He was issued a citation for Operating without headlights / Fail to signal turn. During a person search, police had found more than four grams of cocaine and eventually recovered more than 27 grams of psilocybin from his car.
